Terms and Conditions (T&Cs)

1. Scope of Application

These Terms and Conditions ("T&Cs") apply to all contracts concluded between

(hereinafter referred to as the "Seller")

and customers purchasing products through the Darling Drops online store.

These T&Cs apply to both consumers and business customers unless otherwise expressly stated.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A business customer is any natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business, or profession when entering into a legal transaction.


2. Contract Formation

The purchase contract is concluded with:

The presentation of products in the online store does not constitute a legally binding offer but rather an invitation to submit an order.

By completing the checkout process, the customer submits a binding offer to purchase the selected products.

After the order has been received, the customer will receive an automatic order confirmation by e-mail. Unless otherwise stated, this confirmation constitutes acceptance of the customer's offer.

The Seller reserves the right to reject orders if products are unavailable, if pricing or product information contains obvious errors, or for any other legitimate reason.


3. Contract Language

The contract language is German.

The contract text will be stored after the contract has been concluded and made available to the customer together with the order confirmation.


4. Products and Product Information

The product descriptions in our online store contain essential information about the products offered.

Customers are responsible for reviewing all product information carefully before placing an order.

For food supplements, customers should pay particular attention to the recommended dosage, storage instructions, and any applicable warnings.

Food supplements are not intended to replace a balanced diet or a healthy lifestyle.


5. Prices and Payment

Unless otherwise stated, all prices include the applicable statutory value-added tax (VAT), where applicable.

Shipping costs may apply and will be displayed before the order is completed.

Available payment methods include:

  • PayPal

  • Klarna

  • Credit Card

  • Direct Debit

  • Other payment methods displayed during checkout

Payments are processed in accordance with the terms and conditions of the respective payment service provider.


6. Shipping and Delivery

Orders are shipped from Germany.

We currently deliver to:

  • Germany

  • Austria

Additional EU countries may be added in the future.

Shipments are made via DHL or another suitable shipping carrier.

Estimated delivery times are:

  • Germany: 3–7 business days

  • Austria: 4–8 business days

  • Other EU countries: 5–10 business days

Delivery periods begin once payment has been received unless otherwise specified.

Delivery delays caused by force majeure, supply shortages, or shipping carriers are beyond our control and may extend delivery times.


7. Shipping Costs

Shipping costs depend on:

  • Destination country

  • Order value

  • Selected shipping method

Standard shipping is free for orders of €50 or more, unless otherwise stated during checkout.

Where available, express shipping charges will be displayed before the order is completed.


8. Gift Cards

Gift cards offered by Darling Drops are digital products.

Gift cards may only be redeemed for products available in the online store and cannot be exchanged for cash.

Lost or stolen gift card codes cannot generally be replaced.

The validity period of gift cards is determined by applicable law and any information provided at the time of purchase.


9. Right of Withdrawal

Consumers are entitled to the statutory 14-day right of withdrawal.

Detailed information regarding the right of withdrawal and the model withdrawal form can be found in our separate Withdrawal Policy.

The right of withdrawal may be excluded where permitted by law, particularly for:

  • Opened or unsealed food supplements for reasons of health protection and hygiene.

  • Digital products where the statutory conditions for exclusion have been met.


10. Returns

The terms governing returns are set out in our separate Return Policy.

Where legally permissible, customers are responsible for the cost of returning goods.

11. Statutory Warranty

Customers are entitled to the statutory warranty rights applicable under the relevant law.

Where defects exist, customers may be entitled to repair, replacement, price reduction, or withdrawal from the contract.

For business customers, the statutory warranty provisions apply subject to the applicable legal limitations.


12. Limitation of Liability

The Seller shall be liable without limitation for damages resulting from:

  • Intent or gross negligence;

  • Injury to life, body, or health;

  • Liability required under mandatory statutory provisions.

In cases of slight negligence involving the breach of essential contractual obligations, liability shall be limited to foreseeable damages typical of the contract.

Any further liability is excluded to the extent permitted by law.


13. Food Supplement Disclaimer

Customers are responsible for following the recommended dosage and instructions provided with each product.

If you are pregnant, breastfeeding, taking medication, have a medical condition, or are otherwise unsure whether a product is suitable for you, please consult a physician or another qualified healthcare professional before use.

The Seller accepts no liability for improper or incorrect use of its products.


14. Retention of Title

Goods remain the property of the Seller until full payment has been received.

For business customers, the retention of title remains in effect until all outstanding claims arising from the business relationship have been settled.


15. Business Customers (B2B)

Business customers are required to inspect delivered goods immediately upon receipt and notify the Seller without undue delay of any apparent defects.

The statutory obligations regarding inspection and notification of defects shall apply.


16. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protection provisions applicable in their country of habitual residence.


17. Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform.

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


18. Final Provisions

Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
